Agreement to these terms
These Terms & Conditions ("Terms") apply to the Votearly mobile and web applications and related services operated by Votearly, LLC (collectively, the "Application"). By creating an account or using the Application, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Application.
Eligibility and accounts
You must be at least 13 years old and legally able to agree to these Terms. If your organization provides your access, you must also follow its applicable rules and instructions.
You agree to provide accurate account information, keep it current, protect your login credentials, and promptly notify Votearly if you believe your account has been accessed without permission. You are responsible for activity performed through your account unless prohibited by law.
License to use Votearly
Subject to these Terms, Votearly grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Application for its intended personal, educational, or internal business purposes.
The Application, including its software, design, trademarks, logos, and other intellectual property, is owned by Votearly or its licensors. No rights are granted except the limited right to use the Application under these Terms.
Acceptable use
You may not:
- Use the Application in violation of law or the rights of another person
- Attempt to gain unauthorized access to the Application, another account, or connected systems
- Interfere with the security, reliability, or operation of the Application
- Upload malicious code or use automated methods to abuse or overload the service
- Copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Application except where applicable law expressly permits it
- Misrepresent your identity or use the Application to harass, threaten, defraud, or harm another person
Content and event information
You retain ownership of content and information you submit through the Application. You grant Votearly a limited license to host, process, reproduce, and display that content only as needed to provide, secure, and support the Application and the event workflows you choose to use.
You are responsible for having the rights and permissions needed to submit content. Do not submit unlawful content, malicious files, or personal information about another person without appropriate authorization.
Privacy and third-party infrastructure
Our Privacy Policy explains how Votearly handles personal information. Sentry is used for backend error visibility and debugging, not advertising or behavioral profiling. Expo is used for mobile application build and update-delivery infrastructure, not by Votearly as a user-tracking service.
Availability and updates
The Application may require internet access and compatible software or devices. Your network or device provider may charge you for data or other services.
We may update, add, remove, suspend, or discontinue features to maintain security, comply with law, or improve the Application. Updates may be required for continued use. We will provide notice of material changes when reasonably practical or legally required.
Suspension and termination
You may stop using the Application at any time. Votearly may suspend or terminate access if you materially violate these Terms, create a security risk, use the Application unlawfully, or if continued access could harm Votearly, our users, or others. When practical, we will provide notice and an opportunity to correct a curable violation.
Disclaimers
To the extent permitted by law, the Application is provided "as is" and "as available." Votearly does not guarantee that the Application will always be uninterrupted, error-free, or compatible with every device or network. Nothing in these Terms limits warranties or consumer rights that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Votearly and its officers, employees, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or business opportunities arising from use of the Application.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or willful misconduct where applicable.
Changes to these terms
We may update these Terms as the Application or legal requirements change. We will post the revised Terms with a new effective date and provide additional notice when required. Continuing to use the Application after revised Terms take effect means you accept them.
General terms
If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the agreement between you and Votearly regarding use of the Application, unless a separate written agreement applies.
